Terms of Service

Welcome to RAPP Cloud! This Terms of Service which are incorporated herein by reference and which may be posted and applicable to specific services (collectively, the "Agreement") enables users to access the RAPP Cloud website and use our application programming interface (“API”), content, upload, store, manage and download apps (“Apps”), information and other data and give access to that data to others (all together, “services” and each, a “service”).

Regardless of whether you are a registered user, or are simply downloading an app which does not require a registered account, all such interactions with the RAPP Cloud website and use of any services is an explicit acceptance of this Agreement signifying you have read, understand, and agree to be bound by all of the terms of this Agreement which is a LEGALLY BINDING CONTRACT.

IF YOU DO NOT FULLY AND COMPLETELY AGREE TO THE TERMS OF THE AGREEMENT AND YOU, AS A RESPONSIBLE USER, CHOOSE TO CONTINUE TO USE THE SERVICES, YOU WILL BE BOUND TO THE TERMS OF THE AGREEMENT.

We can change these terms at any time which will become effective immediately upon its posting to the website. Your continued use of the website and any of the associated services means that you agree to the changed terms. If you are dissatisfied with anything related to the RAPP Cloud website and you do not wish to continue to use our services under the new terms, you should discontinue use of the services and may terminate your account before the new terms come into force.

If you comply with these terms, then we grant you a non-exclusive, non-transferable, worldwide license to access and use our services via the website in accordance with these terms.

Your content

Uploaded materials like apps, software, scripts, text, graphics, photos music, videos and any other material that may be viewed on or accessed through the RAPP Cloud website, remains yours. We do not claim any intellectual property rights over the materials you submit to the RAPP Cloud website.

By uploading materials, you affirm and warrant that you own or have the necessary licenses, rights and permissions to store, share or distribute the materials. You also agree to allow other internet users to view your materials you post publicly and to allow the RAPP Cloud website to store and display your materials.

We may monitor or review your content at any time although we are not obliged to do so. We may also alter or remove any of your content at any time, to ensure the operational integrity of our services.

You must maintain copies of all data stored by you on our services. We do not guarantee that there will be no loss of data or the services will be bug free.

Your obligations

You:

should keep your password safe and confidential. We will never send you emails asking for your password
must control your materials through your account and/or cookies which may be placed on your computer or other devices
must comply with these terms and any other agreements you have with us
must not use the services for any illegal or unauthorized purpose
can not use the RAPP Cloud website to upload materials that contain any robots, viruses, worms, Trojan horses or any other damaging items which could interfere with our, or anyone else's, network, device or computer system
may not distribute an illegal or unauthorized copy of another person's trademarked or copyrighted work

You use the services at your own sole risk. The services is provided on an “as is” and “as available” basis without any warranty or condition implied.

To access or benefit from the services on RAPP Cloud you may have to create an account. You are responsible for maintaining the confidentiality of your access information and are responsible for all activities that occur utilizing your information. We will hold you responsible for anything done using your username and password. MAKE YOUR PASSWORD A STRONG ONE AND KEEP IT SECURE. We are not responsible if someone else gains access to your computer or other device and/or your Mega password and/or encryption keys for any files.

Website usage and maintenance

RAPP Cloud services are offered and are only available to individuals who have the minimum age requirement and/or legal entities which are capable of concluding a legally binding contract under applicable law. Without limiting the foregoing, the services are not available to individuals under the age of 18 and/or to legal entities which are not lawfully formed. If you do not qualify for these reasons, the use of the services provided by RAPP Cloud is expressly prohibited. By registering and using the services, you represent that you meet the minimum age requirement and have the legal capacity to accept these Terms and to use the services in accordance with these Terms.

RAPP Cloud reserves the right to partially or fully stop the access to the site for you or for a complete shutdown of the site in general. From time to time and to RAPP Cloud’s sole discretion the site might be down for maintenance. All of the stated in this section can be done without any given notice. RAPP Cloud will not be held liable to a loss caused by one or all of the mentioned above cases.

Limitations on warranties and liability

YOU AGREE THAT YOUR USE OF THE SERVICES SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE (THIS INCUDES OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.

NEITHER WE NOR ANY PROVIDER OF ANY THIRD PARTY CONTENT WARRANTS THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE OR MAKES ANY WARRANTY OF THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICES OR CONTENT. BOTH THE SERVICES AND CONTENT ARE DISTRIBUTED ON AN "AS IS, AS AVAILABLE" BASIS. NEITHER WE NOR ANY THIRD PARTY MAKES ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICES OR CONTENT OR ANY PRODUCTS OR SERVICES SOLD THROUGH THE SERVICES.

NEITHER WE NOR ANY THIRD PARTY WARRANT THAT ANY FILES AVAILABLE FOR DOWNLOADING THROUGH THE SERVICES WILL BE FREE OF VIRUSES OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES. YOU AGREE THAT YOU ASSUME ALL RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICES AND THE ACCURACY AND COMPLETENESS OF THE CONTENT. WE ARE NOT RESPONSIBLE OR LIABLE FOR ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT OR FOR ANY VIOLATION OF ITS AGREEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (THIS INCLUDES OUR EMPLOYEES, OFFICERS, AGENTS AND AUTHORISED RESELLERS) ARE NOT LIABLE WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), EQUITY OR ON ANY OTHER GROUNDS TO YOU OR ANYONE ELSE FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGE, LOSS, COST OR EXPENSE, DAMAGE TO PROPERTY, INJURY TO PERSONS, LOSS OF PROFITS, LOSS OF DATA OR REVENUE, LOSS OF USE, LOST BUSINESS OR MISSED OPPORTUNITIES, WASTED EXPENDITURE OR SAVINGS WHICH YOU MIGHT HAVE HAD, DENIAL OF SERVICE OR ACCESS TO OUR WEBSITE, OCCURRING DIRECTLY OR INDIRECTLY FROM THE USE OR ABILITY OR INABILITY TO USE, OR RELIANCE ON, OUR WEBSITE, OR THE SERVICE AND BASED ON ANY TYPE OF LIABILITY INCLUDING BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE.

Indemnification

You will be held liable and responsible solely for any direct and indirect claims and expenses (including any legal costs) that arise from the following matters:

any product you have uploaded to the site
your usage of the site
any content, graphic materials or files you have uploaded to the site
any breach of the terms and conditions in this agreement

Governing Law / Jurisdiction

The services may be accessed throughout the world. RAPP Cloud makes no representations that the services comply with the laws, including intellectual property laws, of any country outside the United Kingdom. If you access the services from outside the United Kingdom, you do so at your own risk and are responsible for compliance with the laws in the jurisdiction from which you access the RAPP Cloud website.
